What to Include in Your Notice
To be considered effective under 17 U.S.C. § 512(c)(3), your notification must be in writing and include the following:

- Identification of the allegedly infringing material: The specific URL(s) and page location on

- Statement under penalty of perjury: A statement that: “I swear, under penalty of perjury, that the information in this notification is accurate, and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
- Signature: A physical or electronic signature (typing your full legal name is legally acceptable) of the copyright owner or authorized agent.
Response Window & Expedited Artist Requests
Response Window: We acknowledge and process formal DMCA takedown notices within 24 to 48 hours of receipt. Upon confirming a valid notice, we will expeditiously remove or disable access to the identified material.
Informal Artist Requests: We understand that many independent creators prefer straightforward communication over formal legal notices. If you are an artist and simply want your credit link updated, your preferred handle changed, or an artwork removed from the gallery, you do not need to prepare a formal legal document. Simply email [email protected] from an email or account verifiable as the artist, and we will honor your request promptly within 24 hours.
DMCA Counter-Notification Process
If you believe that material you submitted or had listed on Malfoid was removed or disabled by mistake or misidentification, you may file a written counter-notification pursuant to 17 U.S.C. § 512(g)(2) and (3).
Send your counter-notification to [email protected] with the subject line: DMCA Counter-Notification — [Identifier].
Your counter-notification must include:
- Identification of the material: The specific URL(s) or description of the material that was removed or to which access was disabled, and the location where it previously appeared.
- Your contact information: Your legal name, physical address, telephone number, and email address.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Malfoid may be found), and that you will accept service of process from the original complaining claimant or their agent.
- Statement under penalty of perjury: A statement that: “I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.”

Upon receiving a qualifying counter-notification, we will forward a copy to the original complainant. If the complainant does not notify us within 10 to 14 business days that they have filed an action seeking a court order restraining the infringement, we may restore the removed material in accordance with federal law.
Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i)(1)(A), Malfoid maintains a policy to terminate, in appropriate circumstances, access or publication privileges for contributors, users, or submitters who are found to be repeat infringers of intellectual property rights.
